WAIVER POLICY FOR ADVISORS UNDER 21

It is the general policy of the California YMCA Youth and Government to not allow advisors who are under 21 years of age. However, the Governing Board recognizes the fact that some delegations find it extremely difficult to recruit knowledgeable and/or committed advisors and therefore special circumstances might occasionally exist where the survival of the Model Legislature/Court in a local area depends upon recruiting former delegates who are not yet 21. Under these circumstance the CEO of California YMCA Youth and Government or his/her designee is authorized by the Governing Board to establish and administer a waiver policy on behalf of the Governing Board. The terms and conditions of the policy are to be determined by the CEO and are to be administered on a case by case basis.

As such the following policy and conditions for waiver have been established and are in effect immediately. Policy and Conditions:

  1. The local delegation must have at least one advisor who is 21 years of age designated as the lead advisor.
  2. The prospective advisor for whom the waiver is being sought must be at least 18 years old and graduated from high school as of August 31st of the prior year.
  3. Prior delegates must have been out of the program for one full year before returning as an advisor.

The lead advisor and the Executive Director, CEO, or the chief administrator of the organizational unit sponsoring the delegation must submit letters formally requesting the waiver to the California YMCA Youth and Government office. Telephone requests for waivers will not be recognized as valid. Please address the letters as follows:

The letter must indicate: The reason for the waiver request stating the existing conditions that require the use of the 18 year old volunteer recruit, including the hardship needs of the local unit that requires the services of this advisor; indicate his/her understanding of the prospective difficulties in having an advisor this age who has not had the opportunity to separate themselves from their peers; include an indication of accepting responsibility for monitoring the behavior of the advisor; and, provide any other details that would strengthen the case for granting the waiver.

Appeals:

There is only one level of appeal and that is to the CEO of the California YMCA Youth and Government program. In all cases the decision of the CEO is final and without recourse of additional appeal procedures. Should the CEO rather than the Associate Director decide not to authorize the waiver, the decision will be final and cannot be appealed.
